Who can see my Will? New Succession Act SA Unveiled!
South Australia's new Succession Act, effective 1 January 2025, has shaken up the rules around who can see your will after you’ve died. Here’s the scoop:
Who Gets a Sneak Peek?
• People you’ve named in your will or an earlier will (even if you’ve named them to explain why you’re leaving them out!).
• Family members (including your exes!).
• Creditors (if the court allows them to).
• Legal Representatives (your administrator, executor or lawyer handling your estate).
• Anyone one else the court approves.
Why is it a Game-Changer?
This new right to inspect a will boosts transparency and may minimise disputes if everyone knows the terms of the will early on.
What Changed?
There was no right to inspect a will before this. Residuary beneficiaries (those getting the balance of the estate) could see the will, but that was it.
Now, the new Succession Act spells it out clearly.
